In general, Lemon Laws provide remedies to consumers who have experienced repeated, substantial problems related to the safety, use, or value of their new motor vehicle. The North Carolina Lemon Law applies to all new vehicles purchased or leased for family or personal use, including passenger cars, motorcycles, trucks, vans, and motor homes, as long as it does not weigh more than 10,000 pounds. If you have recently bought one of these vehicles and have had to take it to the shop multiple times for repair of the same problem, or it has been in the shop longer than twenty business days within a twelve month period, then it may be a lemon and you may be entitled to enforce your rights under the North Carolina Lemon Law.

You Might You Have A Lemon If...
It can be difficult to know if your defective vehicle is really a lemon or not. Although every vehicle needs repairs from time to time, the North Carolina Lemon Law provides certain rights to new car buyers who experience recurring problems that begin within the first twenty-four months or twenty-four thousand miles of ownership. If this happens, the manufacturer does not get an unlimited number of tries to fix your vehicle. Rather, the North Carolina Lemon Law says that manufacturers, through their authorized dealers, only get a "reasonable number of attempts" to fix the problem and make their product perform the way it should.
How many attempts is reasonable? The North Carolina Lemon Law answers that too! Under the North Carolina Lemon Law, it is "presumed that a reasonable number of attempts have been undertaken" to fix your vehicle if:
- The same problem has been presented for repair to the manufacturer (generally this is done by returning the vehicle to the selling dealer or other authorized dealer) four or more times, but the same problem continues to exist; or
- The vehicle was out of service to the consumer during or while awaiting repair of the problem for a cumulative total of 20 or more business days during any 12-month period of the warranty....
So, if you have purchased a new motor vehicle that that has been experiencing recurring defects or problems, which are actually covered by the warranty, and either 1) you have given the manufacturer, through the dealership, at least three attempts to repair the same problem; or 2) it has been in the shop for close to twenty or more business days over 12 months, then you may have a lemon!
